The Food Protection Program regulates restaurants, grocery and convenience stores, schools, assisted living, seasonal and temporary vendors. Over 400 inspections of permanent establishments and over 200 inspections of temporary establishments are done each year, in addition to approximately 50 Plan Reviews for new establishments.

It is unlawful for a person to operate any Bed and Breakfast Establishment, Retail Food Establishment  and/or Temporary Food Establishment in Howard County without first obtaining a valid Permit from the Health Officer, unless the organization is not a Retail Food Establishment as defined in IC 16-18-2-137 and is tax exempt under Section 501 of the Internal Revenue Service (IRS) Code and the organization can furnish its determination letter to the health department. A permit is required whenever food is provided directly to a consumer who is a member of the general public, unless the food is pre-packaged and not a Potentially Hazardous Food. The permit is valid only for the address/location for which it is issued, unless it is a Mobile Seasonal Permit. The Permit is valid only for the person to whom it is issued, subject to issue and expiration dates, and is not transferable.

Food Handler Certification  is required by Title 410 IAC 7-22 for food establishments, with some menu exemptions.

Before an Annual or Seasonal Permit may be issued for a new establishment, a Plan Review is required. Plan Review is not required for an existing and operating establishment. Registration with the Health Department giving at least 30 days notice of an intent to operate is required. See the Howard County Fee Ordinance for current fees.

A Temporary Food Establishment Permit is required for events up to 14 days. The deadline for a permit application and fee payment to be received in our office is 4:00 p.m. one week prior to the first day of operation. Applications postmarked by midnight one the deadline will be accepted. Please see the Temporary Food Establishment Brochure.

Some food products sold at Farmers’ Markets also require a Food Permit.
