Jurisdiction

 

I.C. 31-30-1-1

 

The juvenile court has exclusive original jurisdiction, except as provided in I.C. 31-30-1-4,  I.C. 31-30-1-9 and I.C. 31-30-1-10, in all proceeding governing the custody and detention of a delinquent child.  Also, the juvenile court has exclusive jurisdiction over violation of I.C. 7.1-5-7 (alcohol offenses) if the child is under the age of eighteen (18).  The juvenile court does not have jurisdiction over any child, if prior to their eighteenth birthday, commits an infraction, a municipal ordinance, or a violation of a traffic offense if the violation is a misdemeanor and the child is sixteen (16) years of age or older.  The juvenile court has exclusive jurisdiction over a juvenile who commits a violation of I.C. 9-30-5 (Operating a vehicle while Intoxicated) prior to the juvenile’s eighteenth birthday.

 

I.C. 31-30-1-4

 

   (a)  The juvenile court does not have jurisdiction over an individual for an alleged violation of:

 

1.

Murder         

(I.C. 35-42-1-1);

2.

Kidnapping

(I.C. 35-42-3-2);

3.

Rape

(I.C. 35-42-4-1);

4.

Criminal Deviant Conduct

(I.C. 35-42-4-2);

5.

Robbery, if:

a.

it was committed while armed with a deadly weapon; or

b.

it results in bodily injury or serious bodily injury;

6.

Carjacking  

(I.C. 35-42-5-2);

7.

Criminal Gang Activity

(I.C. 35-45-9-3);

8.

Criminal Gang Intimidation

(I.C. 35-45-9-4);

9.

Carrying a Handgun without a License

(I.C. 35-47-2-1);

10.

Children and Handguns

(I.C. 35-47-10);

11.

Dealing in a Sawed Off Shotgun         

(I.C. 35-47-5-4.1);

12.

Any offense that may be joined under I.C. 35-34-1-9(a)(2)  with any crime listed In the subdivisions (1) through (11); If the individual was at least sixteen (16) years of age at the time of the alleged violations.

 

 

 

(b)  The juvenile court does not have jurisdiction for an alleged violation of manufacturing or dealing in

cocaine, a narcotic drug, or methamphetamine, (I.C.  35-48-4-1), dealing in a schedule I, II, III, controlled

substance (I.C. 35-48-4-2), or dealing in a schedule IV controlled substance, if:

(1)  the individual has a prior unrelated conviction under I.C. 35-48-4-1, I.C. 35-48-4-2, or I.C. 35-48-4-3; or

(2)  the individual has a prior unrelated juvenile adjudication, that, if committed by an adult, would be a crime

under I.C. 35-48-4-1, I.C. 35-48-4-2, or I.C. 35-48-4-3; and the individual was at least sixteen (16) years

of age at the time of the alleged violation.

(a)  Once an individual described in section (a) has been charged with any crime listed in subsection (a)(1) 

through (a)(12), the court having adult criminal jurisdiction shall retain jurisdiction over the case even if the

individual pleads guilty to or is convicted of a lesser included offense.  A plea of guilty to or a conviction of a

lesser included offense does not vest  jurisdiction in the juvenile court.
